In a residential front yard, 6 feet at most, and anything over 3.5 feet needs zoning approval. As of November 2026, the City of Oakland also asks front fences to be at least 60 percent see-through and at least 18 inches back from the sidewalk. Elsewhere on the lot, wood and metal fences over 7 feet need a building permit.
What are the front-yard limits?
| Item | Limit |
|---|---|
| Without zoning approval | Up to 3.5 feet |
| Maximum fence or freestanding wall | 6 feet |
| Transparency | At least 60 percent see-through |
| Setback from the sidewalk | At least 18 inches |
| Gates | Up to 10 feet tall and 10 feet wide |
That is why open picket fences in metal, wood or vinyl are the usual front-yard choice in Oakland, and why a solid 6-foot privacy panel along the sidewalk usually is not.
What about side and back yards?
The city's fence page focuses on front yards. For side and rear yards, the building permit line is the practical one most homeowners meet: wood and metal fences over 7 feet need a building permit. Zoning height limits for each yard are set in Oakland Planning Code section 17.108.140, and corner lots and street-side yards can have extra limits. We check that section against your lot before quoting a height.

Are masonry walls different?
Yes. Concrete or masonry walls are only exempt from a building permit up to 3 feet under Oakland's local building code amendments. Retaining walls over 3 feet also need building permits.
What about commercial and industrial property?
Commercial and industrial zones allow taller fences, up to 8 to 12 feet depending on the zone, the distance from the street or a residential neighbor, and design review. See commercial fencing.
Can my neighbor build a tall fence to block my view?
Oakland's municipal code treats a fence built maliciously to annoy a neighbor that needlessly exceeds 6 feet as a nuisance. That rule is about intent, not a general height limit. If a dispute is brewing, talk with the city or a lawyer.
